Please read these Terms of Service ("Terms") carefully before using the Nodebook application (web, Android, iOS) and related services. Nodebook is operated by Kamil Zabiegała, a sole proprietor based in Poland ("we", "us", or "our"). By accessing or using Nodebook, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Nodebook in any form, you confirm that you are at least 13 years of age and agree to these Terms and our Privacy Policy. If you do not agree, please do not use the service.

2. Description of Service

Nodebook is a note-taking and mind-mapping application that allows you to import documents (PDF, EPUB, TXT), extract text snippets, and organize them visually on a mind map canvas. The service is available as a web application and as a native Android application.

5. Intellectual Property

The Nodebook application, its design, code, and branding are the intellectual property of the developer. You may not copy, modify, distribute, or create derivative works without explicit written permission.

Your data (mind maps, notes, projects) remains your property. By using the cloud sync feature, you grant us a limited license to store and transmit your data solely to provide the service.

6. Payments, Subscriptions and Merchant of Record

Payments for the Plus and Max plans are processed by Paddle.com Market Limited, which acts as our Merchant of Record (reseller). Paddle handles the transaction, applicable taxes and receipts on our behalf. By purchasing, you also agree to Paddle's Buyer Terms. Charges may appear on your statement as "Paddle" or "Paddle.net".

7. Service Availability

We strive to provide a reliable service but do not guarantee uninterrupted availability. We may temporarily suspend the service for maintenance, updates, or reasons beyond our control. We are not liable for any loss resulting from service interruptions.

8. Disclaimer of Warranties

Nodebook is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. Use of the service is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising from your use of or inability to use Nodebook, even if we have been advised of the possibility of such damages.

10. Termination

You may stop using Nodebook at any time. We reserve the right to suspend or terminate your access if you breach these Terms. Upon termination, your right to use the service ceases immediately. You may export your data using the built-in backup feature before termination.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by updating the date at the top of this page. Continued use of the service after changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of Poland, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Poland.
